Inspecting Your Goods
Please inspect your goods immediately upon delivery.
If your goods are damaged, you must notify us in writing immediately upon delivery.
Unless you notify us of any damage as outlined above, you acknowledge that, to the fullest extent permitted by law:
- you are responsible for the quality, fitness for purpose, and merchantability of the goods following delivery; and
- you are not entitled to a refund of any payment made for the goods or their delivery.
Delivery and Acceptance
To the fullest extent permitted by law, including the Australian Consumer Law:
- if no notification of damage is received immediately upon delivery, the goods are deemed to have been accepted, delivered, and received by you free from damage;
- all risk in the goods passes to you upon delivery, and you are responsible for any loss, damage, or liability relating to the goods after delivery; and
- except as expressly stated in these Terms, all other representations, warranties, guarantees, and terms (whether express or implied) relating to the goods are excluded.
Your Rights Under Australian Consumer Law
We acknowledge that you have statutory rights under applicable laws, including the Australian Consumer Law.
Nothing in these Terms is intended to limit or exclude any right or remedy available to you under the Australian Consumer Law or any other law where those rights cannot legally be limited or excluded.
If you are a consumer within the meaning of the Australian Consumer Law, our liability for failing to comply with a Consumer Guarantee is limited, to the extent permitted by section 64A of Schedule 2 of the Competition and Consumer Act 2010 (Cth), to:
For goods:
- replacing the goods;
- repairing the goods; or
- paying the cost of replacing or repairing the goods.
For services:
- supplying the services again; or
- paying the cost of supplying the services again.
This limitation does not apply where liability cannot be excluded, restricted, or modified under the Australian Consumer Law.
If we are required to replace the goods under these Terms or the Australian Consumer Law, but are unable to do so, we may refund the amount you paid for the goods.
Warranty
If you are not a consumer within the meaning of the Australian Consumer Law, our liability for any defect or damage in the goods is:
- limited to the value of any express warranty or warranty card provided by us at our sole discretion;
- limited to any warranty to which we are entitled where we did not manufacture the goods; or
- otherwise excluded to the fullest extent permitted by law.
Returns
Subject to the Australian Consumer Law, we will only accept returns where:
- we have, acting reasonably, agreed that the goods are defective or damaged;
- the goods are returned immediately on inspection upon delivery;
- the goods are returned at your cost; and
- the goods are returned in as close a condition to that in which they were delivered as is possible.
Exclusions
Subject to the Australian Consumer Law, we are not liable for any defect or damage that is caused, or partly caused, by or arises as a result of:
- failing to properly maintain or store the goods;
- using the goods for any purpose other than that for which they were designed;
- continuing to use the goods after any defect or damage became apparent, or should have become apparent to a reasonably prudent operator or user;
- failing to follow any instructions or guidelines provided by us;
- fair wear and tear;
- any accident; or
- an act of God.
However, we do not exclude or limit our liability where any defect or damage arises directly from our gross negligence or willful misconduct.
Returns Required by Law
Where we are required by law to accept a return, we will do so in accordance with the conditions imposed by that law.
